All eyes are on the employer and what lies beneath them. Expectations of knowledge, competence, the ability to solve difficult situations and preferably right now. When faced with demanding employeesós, the employer has to measure himself and them even more. The same applies when an intruder appears at work in the form of the ubiquitous coronavirus.

What do the regulations móbind?

Notwithstanding the coronavirus, the employer has a responsibility to ensure that the conditions in which work is to be performed are appropriate. Health and safety regulations specify exactly what requirements must be met in order for a work environment to be called safe and sanitary. Any epidemic further jeopardizes these conditions, hence work must be reorganized to minimize the risk of infection amongóemployees. The role of the boss obliges him to take advantage of all available advances in technology and science when caring for the health and safety of employeesów. By doing so, he will enable his employees to continue working in a place other than the company's headquarters. Working in isolation, such as at home, prevents the spread of infectious diseasesób.

Work under such special conditions is regulated by Article 3 of the March 2, 2020 speculative law. This law mówi on specificól ways to deal with the prevention and control of COVID-19 and other infectious diseasesób and crisesócaused by them (Laws of 2020, item 374). An employee's refusal to work remotely may be considered a violation of employeeós duties. However, remote work should end up to 3 months after the cessation of the epidemic condition. If it is not possible to perform remote work, the employer can send the employee on an outstanding leave. He also has other options, such as sending the employee on parental leave with his consent, giving him other tasks, and, as a last resort, sending him home on full pay.

What obligations does an employer have to employeesów?

Employees during an emergency such as an epidemic may be concerned not only about keeping their jobs, but also about their wages. It is the duty of the employer to maintain full salaries, and the option related to a reduction in salary is possible only under the condition, the conclusion of a change agreement. It is also the employer's duty to initiate accident proceedings if an employee suffers an accident while working remotely from home. On the other hand, the employer is not required to additionally insure the employee working from home.

It is also the employer's responsibility to provide technical supplies to the employee, which includes any equipment, communicatorsów, teleconferencing systemsów, etc. In the face of an infectious disease, the employer must be very meticulous about health and safety rules. He should respond to the reported needs of employeesós, take care of cleaning supplies, protective masks and gloves, respond to the symptoms of illness in employeesós. Added to this is the duty to monitor changes in regulations.

The past year has been a new school for everyone, and it's hard to imagine no mistakesóing even among employersów. In addition to the coronavirus, they have to face their own ignorance and fallibility. Being in the role of an employee, we should therefore put more emphasis on our own responsibility and demand more from ourselves than we do on a daily basis.
